These Terms of Service (“Terms”) govern your use of this website and any purchase from VADEN PEGG FV INC, doing business as Pegg Hearth (“we,” “us,” or “our”).

By browsing the site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the site.

We sell home fragrance products to customers in the United States only. We do not accept orders for delivery outside the United States.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. You confirm that the information you give at checkout is accurate.

3. Products

We sell candles, aroma stones, plaster and ceramic pieces, oils, and lighted decor.

Photos and descriptions are for illustration. Color, texture, and handmade detail may vary slightly.
Candles and oils are for home fragrance. They are not food, medicine, or cosmetics.
Lighted items are decorative. They are not heating appliances or real fireplaces.
Follow the care notes on the product page. Never leave a burning candle unattended. Keep flame, hot wax, and electrical parts away from children, pets, fabric, and water.
Essential oil should be used only as described (usually a few drops on stones). Do not swallow it. Keep it off unfinished wood, fabric, and skin if it irritates you.

We may correct errors, update descriptions, or withdraw a product at any time before we accept an order.

4. Orders and acceptance

An order is an offer to buy. We accept it when we send an order confirmation or when we charge your payment method. We may cancel an order for suspected fraud, pricing error, stock issues, or an address we cannot serve. If we cancel after a charge, we refund the amount we collected.

5. Prices and payment

Prices are in U.S. dollars and are shown at checkout. We may change prices at any time before you pay.

You authorize the payment method used at checkout. Full payment is due when the order is placed unless we say otherwise.

Sales tax is charged where the law requires it, based on the shipping address and Shopify’s tax settings.

6. Shipping

We ship to U.S. addresses only.

Standard Shipping: $6.99
Free shipping on orders of $55 or more
Typical transit: 5 to 8 business days after the carrier scans the package

Transit time starts with the carrier scan, not the moment you check out. Weather, peak periods, and remote addresses can add time. Risk of loss passes to you when the carrier delivers to the address you gave, or according to the carrier’s delivery rules.

You are responsible for a complete, deliverable address. Extra postage caused by an address error may be charged to you.

7. Returns and refunds

Returns, refunds, damaged goods, and lost packages are handled under our Return & Refund Policy, which is part of these Terms.

In short: you have 30 days from delivery to start a return of unused items that meet that policy. Change-of-mind returns are shipped at your cost. We cover return shipping when the item is damaged, defective, or incorrect. Approved refunds go to the original payment method within 5–10 business days after we inspect the return.

8. Promotions

Any discount or free-shipping offer applies only as written at checkout. We may end a promotion at any time. Promotions cannot be combined unless we say so.

9. Accounts

If you create an account, keep your password confidential. You are responsible for activity under your account. Tell us if you think it has been used without permission.

10. Acceptable use

You may not:

Use the site for anything unlawful
Probe, scrape, or overload the site
Copy product photos or text for your own store
Post false reviews or interfere with checkout
Use another person’s payment method without authority

We may refuse service or close an account if these rules are broken.

11. Intellectual property

The store name Pegg Hearth, logos, product photos, and page text belong to us or our licensors. You may not copy them for commercial use without written permission. Product designs supplied by manufacturers remain subject to their rights.

12. Third-party services

Checkout, payments, and shipping use Shopify and their partners. Those services have their own terms. We are not responsible for a third-party site we link to.

13. Disclaimer

The site and products are provided as available. Except for any written warranty we give on a product page or required by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

We do not promise uninterrupted access to the site.

14. Limitation of liability

To the fullest extent permitted by law, VADEN PEGG FV INC and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from the site or a purchase.

Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Some states do not allow certain limits. In those states, our liability is limited to the maximum extent allowed.

This section does not limit liability that cannot be limited under law, including liability for death or personal injury caused by our negligence where such a limit is prohibited.

15. Indemnity

You will defend and hold us harmless from claims, losses, and reasonable legal fees arising from your misuse of the site, your breach of these Terms, or your misuse of a product after delivery.

16. Privacy

Our Privacy Policy explains how we collect and use personal information. It is part of these Terms.

17. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Courts located in Pennsylvania have exclusive jurisdiction over disputes, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property.

18. Changes

We may update these Terms. The date at the top will change. If you continue to use the site after an update, you accept the revised Terms. For an order already placed, the Terms in effect when you checked out apply to that order.

19. General

If a part of these Terms cannot be enforced, the rest remains in effect. Our failure to enforce a term is not a waiver. You may not assign your rights under these Terms without our consent. We may assign them as part of running the business.

These Terms, the Privacy Policy, and the Return & Refund Policy are the entire agreement between you and us for use of the site and for purchases.
